DMCA Policy
New Zealand England Face-Off ("we", "us", or "our") is committed to respecting the intellectual property rights of others and expects our users to do the same. This DMCA Policy outlines our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act ("DMCA").
The DMCA provides a mechanism for copyright owners to notify online service providers of alleged copyright infringement. When we receive a valid DMCA notice, we will expeditiously remove or disable access to the allegedly infringing content. We also have procedures for submitting a counter-notification if you believe your content was removed in error.
Filing a DMCA Notice
If you believe that your copyrighted work has been copied and is accessible on New Zealand England Face-Off in a way that constitutes copyright infringement, you may submit a written DMCA takedown notice to our designated Copyright Agent. To be effective, the notification must be a written communication that includes substantially the following:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of infringing material: A description of the material that you claim is infringing and where it is located on the New Zealand England Face-Off website, with sufficient detail to allow us to find the material (e.g., specific URLs).
- Contact Information: Your name, address, telephone number, and email address.
- Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy and Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or authorized to act on behalf of the owner, of the copyright that is allegedly infringed.
- Electronic or Physical Signature: An electronic or physical signature of the copyright owner or a person authorized to act on their behalf.
Please send your DMCA notice to our designated agent via the contact link provided at the end of this policy.
Filing a Counter-Notification
If you believe that your content was removed or disabled as a result of mistake or misidentification, you have the right to submit a counter-notification. To be effective, the counter-notification must be a written communication that includes substantially the following:
- Identification of Removed Material: A description of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled.
- Statement of Good Faith Belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your Contact Information: Your name, address, telephone number, and email address.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which New Zealand England Face-Off may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Electronic or Physical Signature: Your physical or electronic signature.
Please send your counter-notification to our designated agent via the contact link provided at the end of this policy. Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored in 10 to 14 business days after receipt of the counter-notification.
